Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PayerBenchmark website and API (collectively, the "Service"), operated by PayerBenchmark ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.


1. Acceptance of Terms

By creating an account, requesting an API key, or otherwise using the Service, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to comply with them in full.

2. Description of Service

PayerBenchmark provides a REST API and web interface that indexes and serves healthcare price transparency data sourced from CMS Machine-Readable Files (MRFs) published under the Transparency in Coverage rule (45 CFR § 180). The Service allows authorized users to query negotiated rates, out-of-network amounts, and CPT/HCPCS code benchmarks across major US health payers.

3. API Access and API Keys

  • API keys are issued per account and must not be shared, published, or embedded in client-side code.
  • You are responsible for all activity that occurs under your API key.
  • We reserve the right to revoke or rotate API keys at any time if misuse is detected.
  • Rate limits apply per plan tier. Exceeding rate limits will result in throttled or blocked requests.

4. Permitted Use

You may use the Service to:

  • Build internal tools, dashboards, or products that leverage healthcare price transparency data
  • Perform benchmarking, analytics, and research using the rate data provided
  • Integrate the API into your own software products or services

5. Prohibited Use

You may not use the Service to:

  • Resell, sublicense, or redistribute raw API data as a standalone data product without written permission
  • Scrape, crawl, or bulk-export data beyond the limits of your plan tier
  • Attempt to reverse-engineer, circumvent, or disrupt the Service infrastructure
  • Use the data in violation of applicable healthcare regulations including HIPAA
  • Misrepresent the source of the data or imply affiliation with any payer, CMS, or government agency

6. Data Accuracy and Disclaimer

All rate data served by PayerBenchmark originates from publicly available CMS Machine-Readable Files. While we make reasonable efforts to normalize and validate this data, we make no warranties regarding the accuracy, completeness, or fitness for purpose of any data provided. The Service is not a substitute for direct payer contract verification.

PayerBenchmark is not affiliated with any health insurance payer, CMS, or any government agency.

7. Billing and Plans

  • Free tier plans are subject to rate limits and may be modified or discontinued at any time.
  • Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law.
  • We reserve the right to change pricing with 30 days' notice to registered users.
  • Failure to pay may result in suspension or termination of your account.

8. Intellectual Property

The PayerBenchmark brand, logo, website design, and proprietary data pipeline are owned by PayerBenchmark and protected by applicable intellectual property laws. The underlying MRF data is publicly available under CMS regulations and is not claimed as proprietary by PayerBenchmark.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. You may cancel your account at any time by contacting us. Upon termination, your right to access the Service ceases immediately.

10. Limitation of Liability

To the maximum extent permitted by law, PayerBenchmark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless PayerBenchmark and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the federal or state courts located in Delaware.

13. Changes to These Terms

We may update these Terms at any time. We will notify registered users of material changes via email and update the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the revised Terms.
